First round goes to…our Community!
On Thursday, December 19 our lawyers presented our Motion for Leave to Intervene as a Party in the matter of the 40% Agreement ongoing between the City of Ottawa and ClubLink at the Elgin Street Courthouse. Thank you again to all of you who came out to fill Courtroom 31.
Justice MacLeod rendered his decision today and the Coalition was successful in being granted leave to intervene as an added party to the City of Ottawa application.
We will have the right to file an affidavit, cross-examine either ClubLink or the City’s affiants (should we decide this is necessary) and then make both written and oral arguments at the hearing tentatively scheduled for the last week of February 2020. The Coalition was not granted an independent right of appeal, meaning that it cannot initiate an appeal. In the event that either party appeals, the Coalition may participate subject to directions from the Court of Appeal.
This intervention will give the Coalition standing from which to argue the rights and interests of the Kanata North residents and community members to access our open and green spaces designated within the 40 Percent Agreement . We will be arguing in support of the City of Ottawa position that the 40 Percent Agreement remains in force and that ClubLink must make the golf course lands available to the City under the terms of the agreement if it no longer wishes to operate a golf course.
Our counsel will join the City of Ottawa counsel in Court the last week of February for a two day hearing to defend the 40 Percent Agreement.
