The City has doubled down on its commitment to fight the proposed ClubLink/Minto/Richcraft development with a decision to appeal the recent Labrosse decision on the 40% Agreement (40PA).   The Notice of Appeal was filed on Monday (PDF, 208 Kb).  The Kanata Greenspace Protection Coalition is pleased.

The analysis by the KGPC legal team identified the same legal concerns.  Questions arise around how Judge Labrosse interpreted the directions of the Court of Appeal on the scope of his review, as well as the case law applicable to his decisions around the inoperability of certain clauses among other issues.   The City’s appeal will address these.

However, the important legal issue of severance as related to the two clauses struck from the 40PA by the Court of Appeal was argued by the KGPC legal team.   We feel it was not fully considered in the Labrosse decision.  It is highly consequential and needs another day in court.  The KGPC feels obligated to pursue that on behalf of our supporters and our community alongside the city.   To do that we will need your financial support.   But first, the KGPC commitment is always to keep you fully informed.  Here’s your chance to get up to speed and get your questions answered.

We do understand that these are difficult times on so many levels.  We feel it too.  Tragic and disheartening news from around the world add to the real difficulties of life we face day to day.  Tough on both the head and the heart.  But we can’t and won’t be worn down.  Our beautiful Greenspace is good for the mind and body during these trying times.  Golf is over for the season and we see many of you are out enjoying walks and runs on our beloved Greenspace.

We encourage you to come and join us at our Town Hall.   There is a ton of positive energy in being together and taking on a problem that can be stopped!  Come out and feel better. Hear how the City and KGPC and others are working together to protect your property, our community and Save our Greenspace from ClubLink/Minto/Richcraft!
