Rather than leave you hanging, we have decided to post the most frequent questions we’ve received from our supporters in recent weeks and answer them as honestly as we can.

We’ll start this e-News with an apology for its delay.  It was longer than expected for a couple of reasons.   Frankly, we were waiting for facts to solidify around the Kanata Golf Club (KGC) land sale issue and, regrettably, we are still short on many.   Rather than leave you hanging, we have decided to post the most frequent questions we’ve received from our supporters in recent weeks and answer them as honestly as we can.  See that section below.  Secondly, your writer had some surgery last week which has made preparing this content difficult.   We are on the mend as this week wraps up and working as hard as we can to get this to you.

First and foremost, we feel it is imperative to say at this moment that we truly believe the City of Ottawa continues to stand with our community in opposition to the development of the Kanata Golf Club (KGC) lands.  Do not be put off or left sleepless or anxious by rumours or especially colourful flyers distributed by opportunists posing as less than professional real estate agents who are simply out to make a fast buck on your frustrations, angst and fears.  Push this garbage aside.  Instead, we challenge you to be cautious as to where you get your information.  And yes, we do understand that when information is in short supply that can become even more difficult.  BE PATIENT.
On this complex matter, the City of Ottawa is standing between the developer(s) and the community.  As a result, it is the best source of critical information.   We work diligently to be the close second.  Let’s be perfectly clear – your best access point for city information is Kanata North Councillor Cathy Curry.  Over 5 years, we have found her to be an honest broker, committed to our community and serving it diligently at the City of Ottawa.  She does what she says she is going to do.  We have found her to be reliable.  We have come to trust her.  We believe you can too.

Our review of alternative legal options is complete … for now

Our legal team has reviewed the situation for additional legal options.  We have reviewed suggestions from a community member believing that there is a legal argument for misrepresentation or breach of contract because clauses within the 40% Agreement (later struck) were hiding the limits of the ‘perpetuity’ argument.  This is not seen to be a supportable argument by our legal team and is seen to be based on poor assumptions at law as well as a failure to read the contract ‘as a whole’ which could well be seen as a mistake in law.  There is no opportunity here.

We have researched the options of injunctions among other remedies with no positive result.

We have also been asked about the ability to launch an action to recover lost property value or even a class-action lawsuit for a group of homeowners for damages.  A lawsuit to recover lost value or use of personal property is best brought by the individual landowner(s) involved.  The KGPC is not a property owner and so it would not be reasonable to launch such an action on behalf of the community or its supporters.

OLT one day hearing – Wednesday, November 26

You will recall from our last e-News that ClubLink requested a Final Decision from the Ontario Land Tribunal (the “Tribunal”) even though there has been no agreement on the 192 performance clauses contained in the original decision.  The KGPC will have our lawyer Sylvain Rouleau, Partner, WeirFoulds LLP in attendance.

The Tribunal will conduct a Case Management Conference (the “CMC”) by Video Conference for this matter at 10:00 AM on Wednesday, November 26, 2025 and access will be at https://global.gotomeeting.com/join/344779885 using Access code: 344-779-885.

The Tribunal has set aside 1 day for this matter. The Tribunal’s Rules of Practice and Procedure can be found at: https://olt.gov.on.ca/legislation-and-rules/

The event will be held using GoTo Meeting. The appellant(s), applicant, municipality or approval authority, and those persons who intend to request party or participant status, are asked to log into the video hearing through the link provided above at least 15 minutes before the start of the event to test their video and audio connections. We have spent time fielding answers to your most frequently asked questions over the past few weeks.  We do not have all the answers and in many cases, being honest, you are asking to predict the future.  We cannot responsibly do that.
We have included a few FAQs here just to get you started.  The balance of the FAQs are on our website and we will update them going forward.

Q1:  Who now owns the golf course lands?  Has a developer purchased the golf course lands from ClubLink?  How much did they pay?

A1:  We understand the property is currently registered to ClubLink and Minto.  The ownership and sale price are updated in the Land Registry Offices (LRO) after a property sale closes.

Q13: Are we going to have a town hall meeting?

A13: We know there’s interest in having a town hall, but we feel that it would be better to wait until we have more facts to share and discuss.  A virtual Q & A seems like a better option at this time of year with the Holidays approaching.  We will look for dates in early December, following the OLT hearing.   Stay tuned.

Coyote Information Session with Coyote Watch Canada

Join us for an information session with Coyote Watch Canada (CWC).  During this session, attendees will learn about coyotes in suburban settings and how to foster safe human-coyote interactions. CWC is a federal not-for-profit organization that advocates positive human-wildlife coexistence, focusing on canids. Event attendees will hear CWC Founder and Executive Director Lesley Sampson discuss best practices for residents living with coyotes and may elect to participate in a brief Q&A period.

In closing, we recognize that the loss of the 40% Agreement at the Supreme Court has been most stressful as too has been the finality of the closure of the golf club.    We regret it too.   However, we encourage you to be patient … and positive.   There are a lot of questions that we cannot answer yet.   The processes to be played out in the coming weeks and months and possibly longer cannot be hurried. Rest assured, the City continues to oppose the development plan and the KGPC remains committed to ensuring the community stays focused in opposition to the development and in support of our greenspace.
