We are set for the three day online hearing to defend the 40% Agreement to begin on Monday morning, July 13 at 10 am.
The planned agenda expects the City of Ottawa and the Coalition to present their arguments and evidence throughout the day on Monday. An equal amount of time will be allotted Tuesday for ClubLink to respond. Wednesday will then be available for rebuttal by City and the KGPC and may well be less than a full day.

This past week three compendia were filed with the court by the various participants. A compendium is the compilation of all documents that each party or intervenor will refer to in its submission to the judge. It simply puts all of the documents in one place for quicker and easier access. We have downloaded the three compendia; if you open them, you will be able to follow along when they are referred to by the various counsel throughout the hearing. Please note, these are extremely large files and are not well suited for printing.
What happens after the 40 PA hearing?
The current expectation is that the court decision may take several months. This is entirely in the hands of the judge. Following his decision, either party can take action such as an appeal to the Ontario Court of Appeals. The KGPC will monitor all of this closely alongside our experts and keep you up to date on any happenings, their timelines and any action the Coalition might consider down the road.
Remember, the Coalition will stay ready to represent our donors and supporters and our community as we protect our critical and irreplaceable greenspace.
What else is the Coalition doing?
We’re following all of the bouncing balls.
Ball 1: The 40 % Agreement. You’re on top of that now.Ball 2: The planning process at City Hall. We have received no news from the City that it received a response from ClubLink to the January 2020 request for over 240 additional information and clarification requests on the original development application.
Ball 3: The ClubLink appeal to the Local Planning Appeals Tribunal (LPAT). We understand that there has been no change on this file to this point. Remember, that this application was made by ClubLink at the 11th hour before the Covid outbreak was officially called on March 13. Our experts are following its progress.
The KGPC is working hard to keep you informed in the very best ways we can.

So, at last, the hearing is here. We’ve worked hard together to ensure our community was not only heard in opposition, but also, that we can participate in the court to support the City in its fight to protect our cherished greenspace by defending the 40% Agreement.
